BE IT KNOWN, that Provident Funding Associates, L.P., the above-named Plaintiff, by its attorney, J. Dustin Smith, has filed in the office of the Clerk of the Kosciusko Superior Court #3 its Complaint against Defendant Webster Lake Homeowners Association, and the said Plaintiff having also filed in said Clerk’s office the affidavit of a competent person showing that the residence and whereabouts of the Defendant, Webster Lake Homeowners Association, upon diligent inquiry is unknown, and that said cause of action is for default on the promissory note and to foreclose a mortgage on the following described real estate in Kosciusko County, State of Indiana, to wit:
Tract I: Lot Numbered Fifty (50) in Block "A" in the Plat of Epworth Forest, which plat is located in Section 11, Township 33 North, Range 7 East, as recorded in Plat Book 2, page 258, in the Office of the Recorder of Kosciusko County, Indiana.
Together with a tract of land lying adjacent to and extending from the lateral lot lines of said lot to the water's edge of Lake Webster as found in Record of Submission, Findings of Fact with Opinion and Judgment filed August 2, 1994. in Kosciusko Circuit Court as Cause Number 43C01-9109-CP-732, in the Office of the Clerk of Kosciusko County, Indiana.
Tract II: A tract of land being a part of the Southeast Quarter of Section 11, Township 33 North, Range 7 East, 2nd P.M., Tippecanoe Township, Kosciusko County, Indiana, more particularly described as follows:
Commencing at the Northeast corner of Lot Number Fifty (50) in Block "A" of Epworth Forest; thence North 62 degrees East, 30.0 feet to a 1/2 inch iron bar and the point of beginning; thence North 26 degrees 14 minutes 00 seconds West, along the East line of a public road, 45.08 feet to an iron rod; thence North 64 degrees 59 minutes 40 seconds East, 36.29 feet to an iron rod; thence South 56 degrees 39 minutes 00 seconds East, 43.44 feet to an iron rod; thence South 23 degrees 11 minutes 00 seconds East, 19.58 feet to a 2 inch won pipe; thence continuing South 23 degrees 11 minutes 00 seconds East, 1 foot, more or less, to the shoreline of Webster Lake; thence Southwesterly and Westerly along said shoreline, 47 feet, more or less, to a point North 76 degrees 21 minutes 00 seconds East, 13 feet, more or less, from the point of beginning; thence South 76 degrees 21 minutes 00 seconds West, 13 feet, more or less, to the point of beginning.
commonly known as 8791 East Wesley Lane, North Webster, IN 46555.
NOW, THEREFORE, said Defendant is hereby notified of the filing and pendency of said Complaint against them and that unless they appear and answer or otherwise defend thereto within thirty (30) days after the last notice of this action is published, judgment by default may be entered against said Defendant for the relief demanded in the Complaint.
