NAPPANEE BOARD OF ZONING APPEALS

    The City of Nappanee Board of Zoning Appeals will hold a public hearing Tuesday, September 8, 2020 at 7:00 p.m. in the Council Chambers of the City Municipal Building, 300 W. Lincoln St., Nappanee, Indiana.

    The purpose of the Hearing is to hear Special Use request #02-20-SU, filed by Kenton & Emily Hostetler, 1061 Parkwood Drive Nappanee, IN 46550.

    The request is for a Special Use variance to allow a Bed & Breakfast business to be located at 1061 Parkwood Drive Nappanee, Indiana.

    LEGAL DESCRIPTION OF THE PROPERTY: Parcel # I

A part of the Southwest Quarter of Section 30, Township 35 North, Range 5 East, Elkhart County, Indiana and described as follows:

    Commencing from the Northeast corner of Lot 102 of Northwood Fifth

Addition as recorded on April 22, 1977 at the Office of the Recorder, County of Elkhart, Indiana, under document No. 612250, thence South 09 degrees 06 feet 59 inches West along the East line of said Lot 102, 50.59 feet; thence South 88 degrees 38 feet 00 inches East, 144.72 feet to the point of beginning; thence North 00 degrees 38 feet 00 inches West 396.10 feet; thence North 89 degrees 22 feet 00 inches East, 10.0 feet; thence South 00 degrees 38 feet 00 inches East 396.45 feet; thence North 88 degrees 38 feet 00 inches West, 10.03 feet to the point of beginning and containing 0.091 acres more or less.

    Parcel # II

    A part of the Southwest Quarter of Section 30, Township 35 North, Range 5 East, Elkhart County, Indiana more particularly described as follows:

    Assuming the North line of Lot 102 in the recorded plat of Northwood Fifth (Elkhart County Plat Book 12, page 95)  to have a bearing of North 89 degrees 41 minutes 40 seconds West; commencing at the Northwesterly corner of said lot, said point being on a curve, the tangent to said curve at this point having a bearing of North zero degrees 19 minutes 20 seconds East; thence Northerly along said curve bearing left with a radius of 325.57 feet and along the Easterly line of Parkwood Drive as platted and used in said recorded plat, 5.33 feet to the point of tangent of said curve thence north zero degrees 38 minutes West along the Easterly line of said Parkwood Drive 140.73 feet to and iron stake at the Northwesterly corner of land conveyed to Gene M and Janet Heckaman (Elkhart County Deed Record 368, page 175) for the beginning point of this description; thence North zero degrees 38 minutes West along the Easterly line of said Parkwood Drive and the Northerly extension thereof, 193 feet to an iron stake; thence North 89 degrees 22 minutes East 266 feet to an iron stake; thence South zero degrees 38 minutes East 396.10 feet to an iron stake; thence North 88 degrees 38 minutes West 21.01 feet to an iron stake at the Southeasterly corner of said Heckaman land, thence North zero degrees 38 minutes West along  the Easterly line of said Heckaman land 202.37 feet to an iron stake at the Northeasterly corner of said Heckaman land; thence South 89 degrees 22 minutes West along the Northerly line of said Heckaman land 245.00 feet to the place of beginning, containing 1.28 acres more or less.

    A copy of such proposal is on file in the office of the Zoning Administrator of the City of Nappanee, Indiana, City Municipal Building, 300 W. Lincoln St., Nappanee, Indiana.

    Written objections that are filed with the office of the Zoning Administrator of the City of Nappanee before the hearing will be considered.

    All concerned citizens will be offered the right to speak and voice their comment at the Public Hearing. The Public Hearing may be continued from time to time as may be found necessary.

    Anyone who requires an auxiliary aid or service for effective communication, or a modification of policies or procedures to participate in a program, service, or activity of the City should contact the Office of the City Clerk-Treasurer, 300 West Lincoln Street, Nappanee, Indiana 46550, (574)773-2112, [email protected] as soon as possible but no later than 48 hours before the scheduled event.

    In light of COVID-19 and Governor Holcomb’s Executive Order #20-18 Directives for Hoosier to Stay Home, the City of Nappanee Board of Zoning Appeals will also hold this public hearing via teleconference/video. Access to this information will be posted on the doors of City Hall 48 hours prior to the meeting. Information will also be posted on the web site Nappanee.org and Nappanee Facebook page.
