NOTICE TO NAMED FATHER

IN THE KOSCIUSKO CIRCUIT COURT

KOSCIUSKO COUNTY, INDIANA

IN THE MATTER OF THE ADOPTION OF

AVA M. WETZEL and

ETHAN M. WETZEL

CAUSE NUMBER 43001·2008-A D-000026

    TO:  James Matthew Wetzel

    James Matthew Wetzel, who has been named the father of the children born to Christine Egolf, on September 5, 2005 and December 8, 2006, or who claims to be the father of the children born to Christine Egolf on September 5, 2005 and December 8, 2006, is notified that a petition for adoption of the children was filed in the office of the Clerk of Kosciusko Circuit Court, 121 N. Lake Street, Warsaw, Indiana 46580 on August 6, 2020.

    If James Matthew Wetzel seeks to contest the adoption of the children, he must file a motion to contest the adoption in accordance with I.C. 31-19-10-1 in the above named court, or a paternity action under I.e. 31-14 not later than thirty (30) days after the date of service of this notice.

    If James Matthew Wetzel:

        (1) Does not file:

        (A) A motion to contest the adoption; or

        (B) A paternity action under I.C. 31-14;

    within thirty (30) days after service of this notice;

or

        (2) After filing a paternity action under I.C. 31-14 fails to establish paternity within a reasonable period as determined by the paternity court under I.C. 31-14-21-9 through I.C. 31-14-21-11; the above named court will hear and determine the petition for adoption.     His consent will be irrevocably implied and he will lose his right to contest either the adoption or the validity of his implied consent to the adoption. He will lose his right to establish his paternity of the children under I.C.

31-14.

     Nothing Christine Egolf or anyone else says to James Matthew Wetzel relieves James Matthew Wetzel of his obligations under this notice.

    Under Indiana law, a putative father is a person who is named as or claims that he may be the father of a children born out of wedlock but who has not yet been legally proven to be the children's father.     For purposes of this notice, James Matthew Wetzel is a putative father under the laws in Indiana regarding adoption.

    This notice complies with I.C. 31-19-4-4 but does not exhaustively set forth the putative father's legal obligations under the Indiana adoption statutes.     A person being served with this notice should consult the Indiana adoption statutes.
