NOTICE OF PUBLIC HEARING

NAPPANEE BOARD OF ZONING APPEALS

    The City of Nappanee Board of Zoning Appeals will hold a public hearing Tuesday, May 12, 2020 at 7:00 p.m. in the Council Chambers of the City Municipal Building, 300 W. Lincoln St., Nappanee, Indiana.

    The purpose of the Hearing is to hear Variance request #02-20-BZA, filed by Daren Graber 755 Locke Court Nappanee, IN 46550.

    The request is for a variance from the required side yard setback in an R-1 residential district. This variance will allow the construction of a 30 foot by 12 foot 6 inch garage that will have a 5 foot side yard setback on the south property line. The Nappanee Unified Zoning and Subdivision Control Ordinance requires a 15 foot side yard setback in an R-1 district.. The property is located at 755 Locke Court, Nappanee, IN 46550.

    LEGAL DESCRIPTION OF THE PROPERTY: Lot Numbered Fifteen (15) as the said Lot is known and designated on the recorded Plat of Locke Court Subdivision to the City of Nappanee; said Plat being recorded in Plat Book 10, Page 3 in the Office of the Recorder of Elkhart County, Indiana.

    A copy of such proposal is on file in the office of the Zoning Administrator of the City of Nappanee, Indiana, City Municipal Building, 300 W. Lincoln St., Nappanee, Indiana.

    Written objections that are filed with the office of the Zoning Administrator of the City of Nappanee before the hearing will be considered.

    All concerned citizens will be offered the right to speak and voice their comment at the Public Hearing. The Public Hearing may be continued from time to time as may be found necessary.

    Anyone who requires an auxiliary aid or service for effective communication, or a modification of policies or procedures to participate in a program, service, or activity of the City should contact the Office of the City Clerk-Treasurer, 300 West Lincoln Street, Nappanee, Indiana 46550, (574)773-2112, [email protected] as soon as possible but no later than 48 hours before the scheduled event.

    In light of COVID-19 and Governor Holcomb’s Executive Order #20-18 Directives for Hoosier to Stay Home, the City of Nappanee Board of Zoning Appeals will also hold this public hearing via teleconference/video. Access to this information will be posted on the doors of City Hall 48 hours prior to the meeting. Information will also be posted on the web site Nappanee.org and Nappanee Facebook page.
