NOTICE OF SHERIFF'S SALE
By virtue of a certified copy of a decree to me directed from the Clerk of the Superior Court of Kosciusko County, Indiana, in Cause No. 43D03-1809-MF-000088 wherein Fifth Third Bank as Successor by Merger to Fifth Third Mortgage Company was Plaintiff, and Gary L. Moody, II, AKA Gary L. Moody, AKA Gary Moody and First Merchants Bank FKA Frances Slocum Bank & Trust were Defendants, requiring me to make the sum as provided for in said Decree with interest and cost, I will expose at public sale to the highest bidder, on the 26th day of November, 2019 at the hour of 10:00 a.m., or as soon thereafter as is possible, at Sheriff's Office at 221 West Main Street, Warsaw, IN 46580, the fee simple of the whole body of Real Estate in Kosciusko County, Indiana.
Part of a tract of land deeded as the East 4 1/3 acres of that part of the Northwest Quarter of Section 35, Township 33 North, Range 4 East, Kosciusko County, Indiana, lying North of the Pittsburgh, Fort Wayne and Chicago Railroad (Perm-Central Railroad), said part being more particularly described as follows, to-wit:
Beginning at a bolt spike found marking the Northeast corner of said Northwest Quarter; thence South 00 degrees 07 minutes 30 seconds West (bearings in this description are based on an adjoining deed bearing of South 89 degrees 41 minutes 58 seconds East for the North line of the Northeast Quarter of said Section 35), on and along the East line of said Northwest Quarter, a distance of 550.14 feet to an iron pin at the point of intersection with the Northerly right-of-way line of Old Road 30; thence North 70 degrees 40 minutes West, on and along said Northerly right-of-way line, a distance of 180.02 feet to an iron pin; thence North 00 degrees 07 minutes 30 seconds East, parallel to the East line of said Northwest Quarter, a distance of 491.68 feet to a P.K. nail on the North line of said Northwest Quarter; thence South 89 degrees 37 minutes East, on and along said North line, being within the right-of-way of County Road 300 North, a distance of 170.0 feet to the point of beginning.

Together with rents, issues, income, and profits thereof, said sale will be made without relief from valuation or appraisement laws.
