Silver Lake Ordinance

ORDINANCE 12-01-19

    AN ORDINANCE PROHIBITING UNDERGROUND BORING TO PREVENT CROSS BORE WHEREAS, the following underground boring policy to be established within the town limits or within the town utilities of water,wastewater  and storm sewer mains along with all lateral connections for the Town of Silver Lake, Kosciusko County, Indiana.

    NOW THEREFORE BE IT ORDAINED by the Silver Lake Town Council of Silver Lake, Kosciusko County, Indiana as follows:

SECTION 1.

    For the purpose of this ordinance,"person" means an individual, corporation, company, agency, partnership,association or any other entity,hereafter identified as "Person".

SECTION 2.

    No person shall bore in the Town of Silver Lake without obtaining a permit from the utilities department of the Town of Silver Lake and contacting the 811 locating service.

SECTION 3.

    Any person wanting to bore must pay a $1000.00 deposit to the Town of Silver Lake which will be held until project is complete to ensure no damage has been done to the Silver Lake utilities.

SECTION 4.

    A camera must be ran down all lateral or storm sewer main lines crossed to ensure no cross bore has occurred to the sewer lines when finished with boring.

SECTION 5.

    Upon completion of the project and after the utilities department of the Town of Silver Lake has determined that no damage has occurred,deposit shall be returned to the person. If damage is found to have occurred, the Town of Silver Lake shall first utilize the deposit to pay for repairs,and the person will be responsible for all cost of the repairs in excess of the deposit.

SECTION 6.

    This ordinance shall be in full force and effect on _______2020 after its adoption by the Town Council, its publication as required by law,and filed in the office of the Clerk-Treasurer. Adopted this 11th day of December, 2019
