A Fort Wayne man is facing a theft charge after being found in possession of a gun reported stolen in Texas.

Datwan D. Brown, 21, was booked into the Kosciusko County Jail at 7:23 a.m. Sunday for theft of a firearm, a level 6 felony. His preliminary bond was set at $5,250, but he was released on his own recognizance with an initial hearing set for 8:15 a.m. Feb. 21 in Kosciusko County Superior Court III.

On Sunday, Warsaw Police officer Gordon Allen responded to a call about unresponsive persons inside a vehicle parked at a gas station on Executive Drive in Warsaw. Upon arrival, he saw five men inside the vehicle who appeared to be sleeping. Officers woke the men up and identified them. Brown was the third-row passenger.

Allen received information from Allen County that all the men were flagged as armed/gang alerts for Fort Wayne Police Department except one.

While speaking with the men, officers could smell the odor of burnt marijuana. All of the men were removed from the vehicle and WPD officer Phillip Reed used his K-9 partner, Dax, to detect if any drugs were in the vehicle and Dax indicated there was.

Officers searched the vehicle and found loose marijuana material on the floor board. In the third row seating area, officers found a Glock model 26, 9 mm handgun.

Allen spoke with Brown, who admitted the gun belonged to him and he bought it about 1-1/2 years ago, according to court documents. Allen learned the handgun had been stolen from Texas.
