NOTICE OF PUBLIC HEARING

    Notice is hereby given to the citizens of the City of Nappanee, Elkhart and Kosciusko County, State of Indiana, that the Common Council of the City of Nappanee at its regular meeting on Monday May 201h  at 7:00 PM, in the Council Chambers at the Nappanee Municipal Center, will consider a petition from the Nappanee Investment Properties, LLC, to vacate the public right-of? way, of a certain portion of Summit Street lying north of the north  right-of-way line of East Wabash Street and being located within the corporate limits of the City of Nappanee, Indiana.

    The public right-of-way in question is described as follows:

    PUBLIC RIGHT-OF-WAY VACATION DESCRIPTION

    That the legal description of the section of South Summit Street that the Petitioners are requesting the City of Nappanee to vacate is as follows:

    A part of the dedicated right-of-way of Summit Street as shown the Record Plat of Hiram Crowl's Subdivision of Lots No. 23, 24, and 25 of Good's Second Addition to Nappanee; said Plat of Hiram Crowl's Subdivision being recorded in Deed Record 82, Page 252, in the Office of the Recorder of Elkhart County, Indiana; said part of Summit Street being located in the Southwest Quarter (SW1/4) of Section 31, Township 35 North, Range 5 East, City of Nappanee, Union Township, Elkhart County, Indiana; said part of Summit Street being more particularly described as follows:

    Beginning at the southwest corner of Lot Numbered One (1) as said Lot is known and designated on the Record Plat of Hiram Crowl's Subdivision of Lots Number 23, 24, and 25, of Good's Second Addition to Nappanee, Indiana, said Record Plat being recorded in Deed Record 82, Page 252, in the Office of the Recorder of Elkhart County, Indiana; thence west along the eastern extension of the south line of said Lot Numbered One (1) and along the north right-of-way line of Wabash Street, a distance of 40 feet (record) to the southeast corner of Lot Numbered Eight (8) of said Crowl's Subdivision; thence north along the east line of said Lot Numbered Eight (8), a distance of 103.55 feet (record) to the northeast corner of said Lot Numbered Eight (8); thence east along the eastern extension of the north line of said Lot Numbered Eight (8) and along the south line of Lot Numbered Twenty-Two (22) of Good' Second Addition to Nappanee as recorded in Deed Record 66, Page 548, in the Office of the Recorder of Elkhart County, a distance of 40 feet to the northwest corner of Lot Numbered One (1) of said Crowl Plat; thence south along the east line.

    Said Petition will be considered at this meeting and citizens of the City will be given the opportunity to speak during the public hearing.  A more detailed explanation of the Petition to vacate may be reviewed at the Clerk-Treasurer's Office, 300 West Lincoln Street, Nappanee, Indiana weekdays from 9:00AM  to 4:00 PM.
