Kosciusko County Health Department filed a complaint March 2 against the owners and unknown occupants of an Atwood property the department says is uninhabitable.

The commercial rental property at 121 E. Main St.,?Atwood, is owned by Charlene K. Marshall.

According to the complaint, on Jan. 13, the health department served an order to vacate on Marshall and the occupants of the rental property due to a want of repair, which causes the property to be uninhabitable.

The rental property is still occupied in violation of the order. As a result, the complaint said the occupants may be at risk due to want of repair of the property.

The health department requests an order removing all occupants from the rental property, prohibit Marshall from allowing any further occupancy of the property, requiring the property be sealed against unauthorized entry, costs of the action and all other “relief just and proper in the premises,” according to the complaint.
